Disclaimer

In 1997, I completed my dissertation on August Wilson.  Since then, I have visited many websites concerning the life and works of the famous American playwright, Mr. August Wilson.  I bookmarked those sites only to return to them to find that most had disappeared as they became outdated and as computer server space was converted to new projects.

As a human being, this left me frustrated.  As a scholar, I was alarmed by the fact that important literary analysis and historical information August Wilson--particularly information that was written during his lifetime--was disappearing from the Web before my very eyes. 

That's when I launched AugustWilson.Net.

The intention of this website, therefore, is to legally gather and publish as much information as possible on August Wilson and publish it on this site as an educational repository for information concerning the life and works of August Wilson.  This project serves as a resource for students, scholars, and others who want to learn more about a man who is arguably the greatest playwright of the late 20th Century.

Some of the work on this website belongs to me.  Some of it belongs to others.  In cases where the work belongs to others, I have made a good faith effort to contact the owner(s) of these essays and photos either by telephone or email.  In most instances, I have received replies and approvals.  In some instances, I have received no replies.

No on has denied my request to date. Some parties have not answered, but none has objected or charged any fee.

In the instances where I receive no reply---precisely because I do not want to see so much scholarship end up in the "bit bucket"---I have elected to publish these articles on the site for the sake of preserving important scholarly information.  However, within the spirit of the "safe harbor" clause of the Digital Millennium Copyright Act (see below), if any legal copyright holder contacts me and wants his or her information removed from my site, I will comply immediately.

It is important to emphasize that this site is purely educational and non-commercial. I am not interested in competition; I am interested in preservation.  The site generates interesting email discussions, serves as a teaching resource, and provides information for those involved with directing and producing the plays of Mr. Wilson.

I am truly gratified by the support of so many people.

This site accepts no revenue from any source and further is protected by the "safe harbor" clause of the Digital Millennium Copyright Act:

DMCA Title II, the Online Copyright Infringement Liability Limitation Act ("OCILLA") creates a safe harbor for online service providers (OSPs and ISPs) against copyright liability if they adhere to and qualify for certain prescribed safe harbor guidelines and promptly block access to allegedly infringing material (or remove such material from their systems) if they receive a notification claiming infringement from a copyright holder or the copyright holder's agent.

OCILLA also includes a counter-notification provision that offers OSPs a safe harbor from liability to their users, if they restore the material upon notice from such users claiming that the material in question is not, in fact, infringing. OCILLA also provides for subpoenas to OSPs to provide their users' identity.

In plain language: This is a non-profit, educational site. If any serious challenge emerges relating to the  the legal right of this website to publish any article, I will remove the article in question immediately. I am interested in preservation, not competition, and I will work openly to resolve legal questions relating to permission and ownership.
